Federal Court Orders Freedom of Abrego Garcia from Immigration Custody
A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks legal authority.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.
The case stems from a erroneous removal to El Salvador in March, which the government later admitted was an mistake. Following his repatriation to the United States to answer alien smuggling charges, he was detained in immigration custody.
In her order, the judge noted that the authorities does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

The legal proceedings center on conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
